The use of artificial intelligence (AI) in the employment context has skyrocketed in the past year. Employers hoping to utilize this technology to increase efficiency and effectiveness have struggled to determine how federal equal employment opportunity (EEO) regulations apply to these new tools. In response to an Executive Order issued by President Biden, the Office of Federal Contract Compliance Programs (OFCCP) recently issued new guidance for employers using AI and other automated employment decision tools.
